1. GENERAL RENTAL REQUIREMENTS
THESE ARE THE GENERAL RENTAL REQUIREMENTS OF VIRGIN GORDA CAR RENTAL.
A. Rental Rates: Daily Rental rates are based on a 24 hour "rental day" starting at the time of rental. The minimum charge is one day. The renter will be charged for each hour and/or any part of an hour in excess of a rental day the renter keeps the vehicle, until the vehicle is returned, up to the applicable daily rate. A late Return Change Fee of $45 will apply if you return 2 hours or more after your reserved return date and time. If you return 8 hours or more after your scheduled return date and time, a Return Change Fee of $10.99 per day + Daily Rate will apply
B. Driving Age: The minimum age to rent a vehicle at Car Rental Virgin Gorda is 25 years of age. We can however allow under age drivers (21 to 24) subject to additional charges and a week prior notice.
C. Authorized Drivers: The vehicle may be driven only by an authorized driver. An authorized driver is the renter and any additional person who appears at the time of rental, and signs the rental agreement. All authorized drivers must satisfy our age requirements, have a valid driver's license for 2 years or more, and fulfill our other qualifications. Additional fees may apply. D. Fuel Policy: All vehicles need to be returned with the same amount of fuel as when they were picked up. Otherwise, a fuel charge will be applied to your rental contract. All our vehicles require Premium fuel recommended by the manufacturer.
Rental Agreement
VACATION (BVI) LTD., dba Virgin Gorda Car Rental hereinafter called the "Lessor", hereby rents, to the person whose signature appears on page 1 of Agreement, hereinafter called the "Renter", the vehicle there described on the following terms and conditions:
1.(a) Renter will return the vehicle, together with all tires, tools, accessories and equipment to Virgin Gorda Car Rental station or
as otherwise specified on page 1, and on the date specified on page 1, or sooner upon demand by Lessor.
(b) The Lessor May allow the renter to return vehicles at different ports and residence during their departure or at the end of the rental period as a convenience courtesy to the renter. At this arrangement the renter assumes all responsibility for up to12 hours after the agreed return rental term or until the lessor is able to retrieve the vehicle whichever comes first.
2. The vehicle will not be operated:
(a) to carry passengers or property for a consideration express or implied;
(b )to propel or tow any vehicle or trailer or any other object;
(c) in any race, test or contest;
(d) by any other person than renter or second authorized driver, provided that all such operators shall be at least 25 years of age duly qualified and licensed, with at least two years' experience and that such other operator's license is presented to Lessor at the time this rental agreement is entered into.
3. Renter expressly acknowledges personal liability and shall pay to Lessor on demand:
(a) time, premium insurance and miscellaneous charges at the rates specified on page 1 or online reservations hereof and all damages suffered by Lessor due to any breach of this Agreement; (from Page 1 or online reservation) Renter Reserves the right to collect deposit covering estimated rental charges by cash or credit and holds on insurance deductible.
(b) all parking charges and all fines, charges, costs for parking, traffic or other legal violations where caused through the fault of the Renter;
(c) Lessor's costs; including reasonable attorney's fees, incurred in collecting payments due from Renter under thisAgreement;
(d) Lessor's costs to repair collision or upset damages to the vehicle while in renter's possession, whether or not due to Renter's fault, except in any case where the vehicle is operated in accordance with all the terms and conditions of this Agreement and the Renter has accepted and paid the charge specified for Premium Insurance set out on page 1, in which case the Renter's is only liable for the printed amount on page 1.
Liability shall be limited to US 1500.00 for all renters, liability in excess of US$150O.OO shall be waived;
(e) all costs incurred by Lessor will bear interest at 3% per month as of the date of Renter's default.
4. Renter also acknowledges personal liability to pay Lessor on demand any charge or surcharge as applicable being either
(a) taxes imposed by law upon rental transactions; or
(b) reimbursement to Lessor of additional costs paid by Lessor under law in respect of the lease of the vehicle.
5. Renter hereby indemnifies releases and holds harmless the Lessor and its employees of any liability for loss or damage to any property left, stored or transported by Renter or any other person in or upon the vehicle before, during or after the term of this agreement or after the return of the vehicle to Lessor. Renter shall furthermore defend and indemnify Lessor against all claims based upon or arising out of such loss or damage.
6. Any waiver or modifications of any of Lessor's rights under this agreement shall be null and void unless evidenced by a document signed by any of the corporate directors of Lessor.
7. In the event Renter directs Lessor to bill charges hereunder to any other person or organization, such person or organization shall be jointly and severally liable for payment of all such charges.
8. Notwithstanding any of the provisions of this contract, the Renter shall be fully responsible for any and all damages to the vehicle caused by driving over the legal speed limits; leaving the key in the unattended vehicle or leaving the vehicle unlocked, or driving while under the influence of alcohol or drugs, or caused by any other irresponsible action by the Renter or other authorized operators. The Renter shall prove that the vehicle has been operated in accordance with the provisions of this Agreement.
9. Lessor reserves the right to repossess the vehicles at all times if the terms and conditions of this Agreement are not adhered to by Renter and/or any authorized operator. In. such event a repossession charge equivalent to one day's rental shall be payable by Renter to Lessor.
10. Renter is obliged to report any and all occurrences pertinent to the vehicle, such as accidents, damage, theft, etc.. within two hours thereafter to both the Police Department and Lessor.
11. The Lessor reserve the right to post credit charges and issue refund to and from the renter through the name of our sister company BAYVIEW VACATION APARTMENTS in which case the renter will be notified that charges and refund will carry a different company name until technical difficulties can be corrected.
12. Cancellation more than one week prior to the pickup date will have a 0% fee. Cancellations up to one week to the pickup date and time will carry a cancellation fee of 20% of the total rental cost. Cancellations made up to 72 hours before the start of the rental will be charged a fee equal to the deposit amount or 3 days of the rental cost, whichever is greater. Cancellation of a rental agreement after the rental period has begun is subjected to 3 full days rental cost or 20% of the remaining rental period, whichever is greater. No-shows: This is where the vehicle cannot be picked up due to: insufficient or expired documentation; failure to provide a valid credit card containing sufficient funds to cover the deposit or full amount; and / or failure to collect the car at the specified time / date. Refunds will not be given for no-shows.
13. We reserve the right to substitute vehicles when the reserved car type is not available. We cannot always guarantee the brand but we can guarantee a similar car or an upgrade instead.
